Summary: Check Korea's SME employee income tax reduction: qualifying workers and employers, rates, annual cap, application steps, and foreign-worker flat-tax restrictions.

Who this guide is for

Quick Answer

Foreign nationality alone does not establish or exclude eligibility under the employee categories in Article 30 and Enforcement Decree Article 27. Check the worker, employer, qualifying employment dates and exclusions together. The current framework provides a 90% reduction for qualifying young workers or 70% for other qualifying categories, subject to an annual KRW 2 million cap. A foreign-worker flat-tax election cannot be combined with this ordinary tax reduction.

Key points

Detailed explanation

What is Korea’s SME employee tax reduction?

The scheme called 중소기업 취업자 소득세 감면 concerns eligible wages paid by a qualifying small or medium-sized enterprise. It is distinct from a company’s own business-tax relief and from the special foreign-engineer reduction.

A useful starting question for payroll is: “Can you check my eligibility under Article 30, including the employer’s principal industry and my previous qualifying employment?”

What does the current law provide?

Article 30, reviewed for this guide on October 25, 2026, provides the following framework:

Qualifying categoryReduction rateOrdinary period
Young worker90%Five years
Age 60 or over, qualifying disability, or qualifying career-interrupted worker70%Three years

The cap is KRW 2 million per tax year. The law currently specifies qualifying entry into employment through December 31, 2026. That entry-date limit is distinct from the end of an individual’s reduction period. Special military-return provisions can affect the timeline.

Changing employers does not ordinarily restart the original reduction clock. These points come from Article 30; proposed extensions should not be treated as enacted rules.

Can foreign workers qualify?

Our reading of the cited law is that nationality alone is not a general exclusion: Article 30 and Decree Article 27 define qualifying categories and exclusions without a blanket Korean-citizenship condition. This is a statutory reading, not approval of an individual claim.

Under Article 27, the young-worker category generally uses age 15–34 at contract signing; the older-worker category uses age 60 or above. A military-service age adjustment applies only to the service specified in the rule. Do not assume overseas service qualifies.

The exclusions include specified executives, controlling owners and related persons, daily workers, and certain cases where required pension or workplace health-insurance payment cannot be confirmed, subject to stated exceptions. Ask payroll to document how any exception applies.

For career interruption, use the current statutory cross-reference rather than assuming every return to work qualifies. Some NTS overview text still uses the older “career-interrupted women” description; the current Act and Decree refer to qualifying career-interrupted workers.

Is my employer eligible?

The NTS overview requires both SME status and an eligible principal business activity. A workplace’s headcount or use of the word “startup” is insufficient.

Ask HR for a written response to these checks:

QuestionRecord to retain
Is the employer an SME for this scheme?Employer’s eligibility explanation
What is its principal industry?Industry classification and supporting business records
Is that activity covered by Article 27?Applicable industry provision
Does an exclusion apply?Explanation for any ownership, role or insurance issue

Article 27 lists eligible industries with exceptions. For example, it separately lists technical/vocational training and computer academies. Do not infer that every language school or teaching job qualifies because it is an educational business.

How do I apply through payroll?

The NTS process overview distinguishes the employee’s application from the employer’s submission to the tax office.

  1. Gather your contract, category evidence and earlier reduction records.
  2. Ask payroll to verify the employer and employee conditions.
  3. Complete the 중소기업 취업자 소득세 감면신청서 using the applicable form.
  4. Keep a dated copy and obtain confirmation of receipt.
  5. Check later payslips and the annual withholding receipt for how the reduction was handled.

The ordinary employee submission timing under Article 27 is the end of the month following the employment month. Article 30 requires the employer’s beneficiary list by the tenth day of the month after it receives the application. A retired worker can apply to the tax office with jurisdiction over their address under Article 30.

If you missed a step, ask about the appropriate correction procedure for that year. Do not enter an unsupported claim simply to make a forecast show a refund.

How much would I actually save?

A reduction percentage is not a percentage of salary. It also does not guarantee that much cash back. Eligible wage amounts, other income, the annual cap and interactions in the tax calculation matter.

For illustration only, suppose payroll has calculated KRW 1 million as the tax amount to which the applicable reduction percentage is applied. At 90%, the preliminary reduction is KRW 900,000. If that base were KRW 3 million, 90% would be KRW 2.7 million before applying the annual cap. These examples do not calculate anyone’s final tax or refund.

Keep a worksheet showing payroll’s eligible base, applied rate, cap and resulting annual liability. Ask how the reduction affects other items in the calculation, rather than subtracting it mechanically from take-home pay. Local income tax and social insurance should remain identifiable.

Can I combine it with the foreign-worker flat tax?

The NTS foreign-worker guidance issued in January 2026 explains that electing the foreign-worker flat-tax treatment excludes the ordinary exemptions, deductions and reductions covered by that restriction. Do not stack this SME reduction on top of the special flat-tax calculation.

Ask for two complete comparisons using consistent compensation figures: ordinary taxation with eligible relief, and special flat-tax treatment if available. A lower withholding amount on one payslip does not settle which annual outcome is better. See the foreign-worker flat-tax guide.

What should I check before year-end settlement?

Create a short record of unresolved questions: employer eligibility, original start date, remaining period, missing evidence or a past-year omission. Have payroll resolve those items before you rely on an estimated refund.

Use your withholding receipt to reconcile the outcome. If you changed employers, keep the job-change checklist beside the application. For an earlier-year omission, review correction and refund-claim options with the tax office or representative.

Common mistakes

When should you ask a tax professional?

Ask a qualified tax professional if you have income from several countries, business income, unclear tax residency, treaty questions, missing documents, late filing concerns, or a visa situation that depends on tax records. FAQ

Can a foreign employee qualify?

The cited worker categories and exclusions do not impose a general Korean-nationality requirement. This is a reading of Articles 30 and 27, not confirmation of any individual claim. Check all worker and employer conditions with payroll.

Does every employee at an SME get the reduction?

No. Worker category, qualifying dates, employer status, principal industry and statutory exclusions must all be checked.

Is the KRW 2 million cap a guaranteed refund?

No. It limits the reduction for a tax year. Actual benefit depends on eligible tax and the completed calculation; it is not a salary-based subsidy.

Can I also elect the foreign-worker flat tax?

The special flat-tax treatment excludes the ordinary exemptions, deductions and reductions covered by that restriction. Compare the two treatments rather than combining them.

Does changing jobs restart the period?

Do not assume it does. Preserve your earlier reduction and employment records and have payroll verify the remaining eligible period.

What if I missed the application?

Ask payroll or the tax office which correction route applies to the affected year and whether the claim remains in time. An omitted form does not establish either entitlement or a guaranteed refund.
